Terms of Service

These Terms of Service ("Terms") govern your access to and use of Speedracer (the "Service"), operated by Speedracer ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Speedracer is an AI-assisted marketing tool that performs audits, generates deliverables, and runs agents on behalf of your workspace. Outputs are generated by large language models and may contain errors. You are responsible for reviewing any output before publishing or relying on it.

2. Accounts

You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity under your account. You must be at least 18 years old or have the legal capacity to enter into these Terms.

3. Acceptable use

You agree not to:

  • Use the Service for unlawful, infringing, or harmful purposes.
  • Reverse engineer, scrape, or attempt to circumvent rate limits or wallet billing.
  • Submit content that violates third-party rights or applicable law.
  • Use the Service to generate spam, malware, or deceptive content.

4. Billing

Speedracer uses prepaid wallet billing. See our pricing page for details. Top-ups are processed by Paddle.com Inc. or Paddle.com Market Ltd, who act as the merchant of record and handle taxes. All top-ups are subject to our refund policy.

5. Your content

You retain all rights to content you submit ("Customer Content"). You grant us a limited license to process Customer Content solely to provide the Service. We do not use Customer Content to train foundation models.

6. AI output

Subject to your compliance with these Terms, you own the outputs generated for your workspace. You are responsible for ensuring outputs are accurate and lawful before use. Outputs may not be unique — similar prompts can produce similar results for other users.

7. Service availability

We aim for high availability but do not guarantee uninterrupted Service. We may modify, suspend, or discontinue features at any time. We are not liable for downtime caused by third-party providers (including AI model providers and Paddle).

8. Termination

You may stop using the Service at any time. We may suspend or terminate your account for breach of these Terms or for risk reasons (fraud, abuse, legal). On termination, unused wallet balance is handled per the refund policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware.

12. Changes

We may update these Terms from time to time. We will notify you of material changes by email or in-product notice. Continued use after the effective date constitutes acceptance.
